Introduction

This document, entitled Privacy Policy, regulates how DATCOMP processes the personal data of the users of the datcomp.at and datcomp.ro Websites, from now on referred to as the ” Site.”

 

Protecting your data is a priority for DATCOMP GmbH and SC DATCOMP SRL, from now on referred to as ” DATCOMP. ” That is why we aim to offer you a completely safe online experience, ensuring respect for your rights and personal data.

 

According to Regulation 2016/679 on the protection of natural persons concerning the processing of personal data and on the free movement of such data (” GDPR “) and according to Law no. 506/2004 on the processing of personal data and the protection of private life in the electronic communications sector, with subsequent amendments and additions, DATCOMP must process personal data following the principles of processing and only for the purposes specified in this document, such as and under security conditions.

 

Processing principles

The processing by DATCOMP of the personal data of the users of the Website is done in compliance with the following principles:

  • personal data are collected only for specified, explicit and legitimate purposes and are not processed in any other way incompatible with these purposes;
  • personal data must be adequate, relevant, and not excessive concerning the purpose for which they are collected and/or subsequently processed;
  • personal data must be accurate and, if necessary, updated; all reasonable steps must be taken to delete or rectify inaccurate, incomplete data, taking into account the purposes for which they were collected or for which they are further processed;
  • personal data are not kept longer than necessary for the purposes for which they were collected or for which they are subsequently processed;
  • personal data will be processed under security conditions, thus ensuring a level of protection against illegal or unauthorized access, as well as against their loss, destruction, and damage. DATCOMP will maintain the confidentiality of the personal data of the users of the Site according to the requirements of the GDPR

 

Purposes of processing

DATCOMP will process only the appropriate, relevant, and strictly necessary personal data for the identified processing purposes.

 

Personal data are processed for the following purposes, which we will always present to you expressly and explicitly, in principle, through Information Notes or through any other means that are used to ensure user information (e.g., posters, symbols, etc.):

  • contacting you through means of communication to bring you information (i.e., without having a marketing nature);
  • creating and analyzing profiles about you to present you with content adapted to your preferences and to improve our services;
  • the transmission of direct marketing messages through the means of communication for which you gave us your consent at the time of signing up for the newsletter or in other data collection forms to promote the activities, offers, and products of Datcomp, but also of the Partners; the transmission of marketing messages can be carried out both as a result of the creation and analysis of profiles and independently of this;

  • performing economic, financial, and/or administrative management activities in DATCOMP;
  • the centralization of operations and the maintenance of an internal database, in which the information about you is stored so that it can be accessed for use by DATCOMP in its activity (i.e., the use of these data involves their processing by DATCOMP’s internal applications, in the course of commercial action);
  • performing internal analyzes (including statistical analyses, and reports) regarding the client portfolio for the improvement and development of services, as well as conducting studies and market analyses for the progress and development of the services of DATCOMP, the Group, and the Partners;
  • archiving, resolving disputes, investigations, or any other petitions/complaints to which DATCOMP is a party, as well as performing risk controls on DATCOMP procedures and processes, as well as conducting audits or investigations of DATCOMP;
  • ensuring a high level of security both at the level of IT systems (e.g., applications, network, infrastructure, web page) and within physical locations;

 

Information

Every time we obtain personal data from you, or we obtain your data from other entities, we will inform you about aspects related to:

  • the identity and contact details of the controller and the personal data officer;
  • the type of the respective data;
  • processing purposes;
  • processing grounds;
  • the necessity of processing as a result of a legal provision/execution of a contract, as well as the consequences of your refusal;
  • the categories of recipients to whom we send your data;
  • if we transmit this data to a third country;
  • the duration for which we store this data;
  • the period for which we store this data;
  • your rights concerning the processing of personal data.

 

This information will be available either in the Information Notes or in other means used by DATCOMP to achieve this purpose (e.g., posters, symbols, emails, etc.)

 

Access to your data

Access to your data will only be provided to those persons or entities with whom we collaborate in fulfilling the processing purposes and for which we (we or the intended recipients) can justify a legitimate basis, following the provisions of the GDPR, or if we have an obligation legal to provide your data.

 

The following entities and their employees will have access to your data:

  • IT service providers (e.g., software maintenance and development, site maintenance and development);
  • providers of market research services, providers of services through which marketing communications are transmitted, providers of services for monitoring traffic and the behavior of users of online tools, providers of services for personalization of various types of marketing, providers of marketing services through social media resources, service providers for creating the content of marketing forms;
  • the administrator of the DATCOMP Property.

 

We will require these entities and their staff to respect the confidentiality of this data, ensuring a high level of security for processing your data.

 

We will also provide your data to judicial bodies, public institutions, or central and local public authorities, following a justified express request or legal obligation.

 

Security of personal data

We will take all necessary security measures to protect your data transmitted, stored, or otherwise processed against destruction, loss, unlawful or accidental alteration, unauthorized disclosure, or unauthorized access, as well as against any other unlawful processing. The security measures we implement concerning your data can ensure the confidentiality, integrity, availability, and continued resilience of the processing systems and services, as well as the ability to restore the availability of and access to personal data on time if an incident of a physical or technical nature occurs.

 

All personal data will be processed through secure pages that use the SSL encryption system, marked with a lock symbol, positioned at the top of the browser window, in front of the datcomp.at and datcomp.ro address (in the Chrome browser, this lock is accompanied by the word “Secure”)

DATCOMP makes every effort and uses appropriate IT technologies to ensure the protection and security of the data you provide us.

 

In the cases provided for by the GDPR concerning breaches of the security of personal data, DATCOMP will inform the competent authorities and relevant persons accordingly.

 

Accuracy of personal data

DATCOMP processes accurate personal data, having implemented a procedure to update them. Thus, DATCOMP takes all necessary measures to ensure that inaccurate personal data, having regard to the purposes for which they are processed, are deleted or rectified without delay.

 

Storage Period

Your data is processed and stored for the necessary period for which we provide you with the service offered by the Site.

 

After the moment you choose to delete your account, your data will be stored by DATCOMP, for an additional period of 3 years, in the legitimate interest of DATCOMP to be able to access and provide the necessary documentation in case of a potential request in court, complaints, investigations unrolled.

 

Your rights

As a user of the Site, you have the following rights, which can be exercised, individually or cumulatively, regarding the personal data that DATCOMP holds concerning you:

 

The right of access  – you can request confirmation of whether DATCOMP processes your data. If so, you can request access and specific information about them. Following a request made in this regard, DATCOMP will also issue a copy of the processed personal data. The demand for additional documents will be charged according to the actual costs incurred by DATCOMP;

 

The right to rectification  – you can obtain the rectification of your inaccurate personal data and the completion of incomplete ones, including by providing additional information.

 

The right to delete data  (” the right to be forgotten “) – in situations expressly regulated by law, you can obtain from DATCOMP the deletion of said data. Thus, you can request the deletion of your data for any of the following reasons:

  • the data are no longer necessary for the purposes for which they were collected or processed;
  • you withdraw your consent based on which the processing takes place;
  • you object to the processing based on the right to opposition;
  • the processing of your data is illegal;
  • the data must be deleted to comply with a legal obligation owed to DATCOMP.

The right to restrict processing  – you can request the restriction of personal data processing in certain situations expressly regulated by law, as follows:

  • dispute the accuracy of the data for the period in which DATCOMP verifies the accuracy of the data in question;
  • the processing is illegal, and you object to the deletion of the data;
  • if you need this data to establish, exercise or defend certain rights in court, and DATCOMP no longer needs this data;

 

You have objected to the processing of personal data for the period in which we check whether our legitimate interests prevail over your interests, rights, and freedoms.

 

In these situations, except for storage, the data will no longer be processed.

 

The right to object to the processing of personal data  – you can object at any time, for reasons related to your particular situation, to the processing (including profiling) based on the legitimate interest of DATCOMP or, as the case may be, on the exercise by DATCOMP of a task serving the public interest or resulting from the practice of a public authority with which DATCOMP would be vested.

 

Promotional materials sent utilizing electronic communication may contain brief information regarding your possibility of objecting to the processing of personal data for the performance of direct marketing activities. Suppose you object to the processing of personal data for direct marketing activities. In that case, your personal data will no longer be used for these purposes.

 

The right to object to the direct marketing activity carried out by DATCOMP is available if the processing of personal data for direct marketing purposes is based on (i) the legitimate interest of DATCOMP or (ii) the existing contractual relationship with DATCOMP and refers to products similar to those already contracted, and not to the consent given.

 

The right to data portability  – you can receive the personal data provided in a structured format that can be read automatically, and you can request that the said data be transmitted to another operator. This right is applicable only for personal data provided directly by you to DATCOMP and only if the processing of personal data is carried out by automatic means and has as a legal basis either the execution of a contract or the consent of the person concerned.

 

The right to complain – you can complain about how DATCOMP processes your data. The complaint will be submitted to the National Supervisory Authority for Processing Personal Data (” ANSPDCP “).

 

The right to withdraw your consent  – ​​at any time, you can withdraw your consent for the processing of personal data by DATCOMP, in cases where the processing is based on consent. The withdrawal of consent will only affect the future; the processing carried out before the withdrawal remains valid. For example, such a case is the possibility of withdrawing your consent for the transmission of direct marketing messages.

 

Thus, you will have the possibility to withdraw your consent for receiving marketing materials directly from DATCOMP, in the following ways:

  • By contacting DATCOMP, through the means of communication provided below (i.e., post, email);

 

Additional rights related to automatic decisions used in the process of providing DATCOMP services – if DATCOMP makes automated decisions concerning personal data and these decisions significantly affect you, you can (a) obtain human intervention concerning said processing, (b) express the point of view regarding the respective processing, (c) obtain explanations regarding the decision taken and (d) contest the respective decision.

The Data Protection Officer (” OPD “) is the person who can be contacted if there are any concerns regarding any aspect related to the protection of personal data and the exercise of data protection rights.
